Our website grants you non-exclusive limited license to use the Simple Calendar plugins and other products sold through our website (https://simplecalendar.io/) (the “products/software”) in accordance with these Terms of Service (the “license”) issued and operated by our company, Xtendify Technologies (“us”, “we”, or “our”).
Plugin Licensing
All products are licensed under the GNU general public license (http://www.gnu.org/licenses/gpl.html).
Automatic Updates
Automatic updates are available to customers who have purchased a license, but are limited to the number of installs specified on the corresponding pricing page. Installs can be deactivated at anytime from My Account to free up install usage.
Updates are provided for a term of 1 year from the time of purchase. After 1 year either a license renewal or a new license will need to be purchased in order to continue receiving support and product upgrades.
You may not resell access to your account or your license key. All licenses are reserved for individual use and may not be shared by several individuals.
Delivery
After payment has been successfully processed, you will be directed to a copy of your receipt that contains download link(s) and license key(s). This receipt will also be emailed to you. This may take up to 1 hour to arrive, but usually happens instantly when placing the order. If you do not receive an email after this time period, please contact us. You may also login to My Account with the email address you used to purchase the plugin for instant access to all support related material.
Ownership
You may not claim intellectual or exclusive ownership rights to any of our products. All products are property of Xtendify Technologies. They are provided “as is” without warranty of any kind, expressed or implied. We shall not be liable for any damages, including but not limited to, direct, indirect, special, incidental or consequential damages or losses that occur out of the use or inability to use these products.
Site Content
All site content, including imagery and documentation that is published on simplecalendar.io is the property of Xtendify Technologies. Any replicated site content must be authorized in advanced. Content from this site shall not be used or exploited for commercial or non-commercial purposes without the prior written consent of Xtendify Technologies.
Refund Policy
If for any reason you are not happy with our product or service, simply let us know within 30 days of your purchase and we’ll refund 100% of your money. We may ask you for feedback on the plugin and appreciate the opportunity to help solve any problem you have. Refunds do not apply to product updates or annual renewals. No refunds will be given after 30 days from the initial purchase. Please note that by purchasing the plugin, you agree to the terms of the Refund Policy.
Lowest Price Guarantee
If you find that we’re offering a lower price (e.g. a coupon code) within 60 days of your purchase, let us know and we’ll refund you the difference.
Support
Xtendify Technologies offers WordPress plugins “as is” and with no implied meaning that they will function exactly as you would like or will be compatible with all 3rd party components and plugins. We do not provide support services for WordPress itself or other WordPress plugins we have not developed.
Support is offered via a license key. Purchasing a license key gives you access to our support services.
Support and automatic product updates are provided for a term of 1 year from the time of purchase. After 1 year, renewing your license or purchasing a new license will need to be purchased in order to continue receiving support, product updates, and premium functionality.
Support and updates for plugins sold are provided as long as the plugin is actively in development. Should any one of the following occur, Xtendify Technologies will no longer be responsible for providing support for the plugin:
– The plugin is no longer actively developed as a viable product under Xtendify Technologies.
– The plugin or the parent company is purchased or bought out by another company.
– WordPress is no longer actively developed.
While we attempt to provide the best support possible for our plugins, we do not guarantee that any particular support query can, or will be answered to the extent, or within a timeframe that the inquirer is completely satisfied.
License holders cannot distribute, freely giveaway, or resell their license key. The license key is only transferable by contacting us and requesting an official transfer of the license to a new owner. The license is intended to be used on the license holders web site(s). Client site usage is permitted in situations where the license holder maintains an ongoing relationship with the client as a consultant. Only the license holder is permitted to request support or access support resources.
License holders are not permitted to re-post support content or documentation on any external websites, social media outlets, etc. Posting screen captures of this content is also prohibited. Violation will be grounds for immediate termination of the support license and all access to support content and product updates will be discontinued.
Email Policy
Xtendify Technologies may on occasion send you email notifications related to your plugin licenses. These transactional emails may include notification of licensing changes, changes to our terms and conditions, license expiration notices and other transactional emails related to your purchases.
Upon purchasing our products, your email address will be added to a list that receives product updates. You can always opt-out from this email list using the link provided in each email.
Price Changes
Xtendify Technologies reserves the right, at any time, to modify or discontinue, temporarily or permanently, a support license with or without notice. Prices of all products are subject to change.
Indemnity
You agree to indemnify and hold harmless Xtendify Technologies for any third-party claims, actions or suits, as well as any related expenses, liabilities, damages, settlements or fees arising from your use or misuse of our software, or a violation of any terms of this license.
Warranty
Our products are provided “as is” without warranty of any kind, expressed or implied. Xtendify Technologies shall not be liable for any damages, including but not limited to, direct, indirect, special, incidental or consequential damages or losses that occur out of the use or inability to use our products or support.
Our plugins are guaranteed to function on a clean installation of WordPress. We do not guarantee they will function with all 3rd party plugins or with all web browsers. We are not responsible for any plugin compatibility conflicts that may occur. It is our policy to support our plugins as best we can and we will provide support for 3rd party plugin conflicts at our discretion or as time allows. We are not responsible for any data loss or other damages that may occur as a result of installing our plugins.
User Data
All data you input into the Product, including info on your Clients will not be freely given to anyone. We do not, under any circumstances, sell either your Email Data or your Email Contacts’ Personal Data. Only authorized employees have access to view User Data.
If someone originating from your account, account holder or someone contacted via Simple Calendar at the User’s discretion playing role of “Client” complains or contacts us, we might then contact that person.
Information Collection and Use by Us
We are the sole owner of information collected on the Service (including any metadata). We collect information only as necessary to fulfill the purposes set forth in the Privacy Policy and we will only use this information as described in the Privacy Policy. We may combine any or all of this data with other information we collect about you. We may view, copy, and internally distribute content from your emails and account to provide customer support.
Data Collected for and by our Users
As you use the Service, you may import into our system Personal Data of yourself or that of other individuals. We have no direct relationship with the third parties added to the Product or any person other than you, and for that reason, you are responsible for making sure you have the appropriate permission for us to collect and process information about those individuals.
Privacy
The Client is considered the data controller within the meaning of the Act n°7817 of 6 January 1978 on information technology as well as European Union’s 2018 General Data Protection Regulation, data files and civil liberties, in regards to all User Data provided within the framework of the Agreements. The Client therefore undertakes expressly to comply with all applicable data protection regulations and to carry out any necessary formalities.
In compliance with the Act n°7817 of 6 January 1978 on information technology, data files and civil liberties, the Client has a permanent right to access, amend, modify or delete any information related to him/her/it by sending an email to [email protected]. For more details, XTENDIFY TECHNOLOGIES invites the Client to refer to the Privacy policy, which is part of the Agreement (access the Privacy policy).
GDPR COMPLIANCE
Simple Calendar as well as XTENDIFY TECHNOLOGIES have taken necessary steps to be within the compliance standards of the European Union’s General Data Protection Regulation.
